Appeal a Denial

The risk of handling a social security claim on your own is that you may miss a deadline or fail to provide all of the necessary accurate and up-to-date information that is needed by the judge, and if that occurs, your claim may be denied. At Charles Bean & Associates we make certain to properly and timely file the appeals and to compile the most recent medical evidence to prove your claim. We also work with your treating physicians to ensure that the administrative judge handling your appeal has a helpful and complete assessment and medical review from your doctor. Assessments or opinion letters supporting your claim for disability from your physician can be vital in obtaining a successful result. Should the administrative law judge request additional information, our office is experienced and able to fulfill such requests in an efficient and timely manner.

It is important to note that there are a number of different levels when it comes to the appeals process. Charles Bean & Associates have the skills and decades of experience to assist you through:

What is a Request for Reconsideration?

If your initial application was denied, you will need to file a Request for Reconsideration to appeal the SSA's decision. This paperwork will ask what medical treatment you underwent since your initial application was filed along with a list of your current medications. Additionally, you will be asked if there has been a change in your condition since your initial application was filed.

As many as 86% of Requests for Reconsideration are denied, however this often comes down to the fact that applicants do not take the time and effort to properly prepare the documentation that should be provided to the Social Security Administration. This is where expert assistance comes in. Three forms must be submitted with your request - Authorization to Disclose Information to the Social Security Administration, the Request for Reconsideration, and the Reconsideration Disability Report. Charles Bean & Associates can help you complete the required Request for Reconsideration paperwork if we are hired as your representative.

What Happens if Your Request for Reconsideration Is Denied?

If you have already filed a Request for Reconsideration and it was denied, you will need to file a Request for Hearing by an Administrative Law Judge to appeal SSA's decision. This paperwork will ask what medical treatment you underwent since your Request for Reconsideration was filed along with a list of your current medications. Additionally, you will be asked if there has been a change in your condition since your Request for Reconsideration was filed. As your representative, the disability attorneys at Charles Bean & Associates will review your social security file and obtain helpful evidence from your doctors and medical providers. This will help prove at the time of the hearing that you cannot do the work you did before or that you cannot adjust to other work because of your medical condition and that your disability has lasted or is expected to last for at least one year.
